Clearly skill abuse but some people will argue it's not when the person abusing the skill doesn't know. Regardless if they knew, it's still skill abuse, that's a fact. It's just like how some people travel to other countries, do something that is legal in their home country but then later find out, after they've done the action, that it was illegal in the current country they're in. That doesn't mean that the first time they did that action that it was legal in that foreign country.
